Mediation allows you to keep control of the process and the outcomes.

Mediation promotes open, honest, direct communication.

Mediation usually operates as a series of three-way meetings, although the meetings can be initially in separate rooms if there are reasons for this. Usually Solicitors are not present, but they can be. It can also sometimes be helpful to have an Independent Financial Adviser giving input at meetings.

Throughout mediation, you can take independent legal advice, and any proposals you make are not binding until legally formalised, usually with the help of your Solicitor.

As a Collaborative Lawyer, I am able to:

Attend a series four-way meetings with you and the other party and their Solicitor to discuss your issues, share information and negotiate a settlement

Deal with all the paperwork and correspondence involved

Formalise your agreement and make it legally binding:

 

Collaborative Law is based on a commitment to resolve matters by agreement and not to issue Court Proceedings. It can also sometimes be helpful to have an Independent Financial Adviser giving input at meetings.

Solicitor Negotiation. As a Family Solicitor, I am able to:

Solicitor Negotiation usually takes place in letters, but can take place face-to-face.

Solicitor Negotiation has no agreement to avoid Court Proceedings, so the threat of Court Proceedings hangs over the negotiations.

Court Proceedings. As a Family Solicitor, I am able to:

Prepare and issue Court Proceedings on your behalf

Represent you at Court
